  1. Contracts and offers

Question 1. A Virginia brokerage agreement does not state a definite termination date. When does it end?

    Show answer

Answer: B. 90 days after the date of the agreement

Section 54.1-2137(C) requires every brokerage agreement to be in writing with a definite termination date; one that has none terminates 90 days after its date. The agreement must also state the fees and the services.

From Code of Virginia § 54.1-2137. Commencement and termination of brokerage relationships; brokerage agreements required · § 54.1-2137(C)

  2. Agency and brokerage

Question 2. When must a Virginia licensee engaged by a buyer sign a brokerage agreement with that buyer?

    Show answer

Answer: A. Before showing the buyer any property

Under section 54.1-2132(A)(1), a licensee engaged by a buyer must enter into a brokerage agreement with the prospective buyer before showing property to that buyer.

From Code of Virginia § 54.1-2132. Licensees engaged by buyers · § 54.1-2132(A)(1)

  3. Disclosures

Question 3. A Virginia listing agent has a substantive discussion about a specific house with a buyer who has no agent. When must the agent disclose, in writing, whom the agent represents?

    Show answer

Answer: C. At the earliest practical time, and no later than when specific real estate assistance is first provided

Section 54.1-2138(A) requires the written disclosure at the earliest practical time, but in no event later than when specific real estate assistance is first provided. Combined with other papers, it must stand out: bold, all capitals, underlined or boxed.

From Code of Virginia § 54.1-2138. Disclosure of brokerage relationship in residential real estate transactions · § 54.1-2138(A)

  4. Agency and brokerage

Question 4. A Virginia licensee wants to act as a dual agent in a home sale. What does the law require first?

    Show answer

Answer: D. Written consent of all parties, given after a written disclosure of what dual representation means

Section 54.1-2139(A) requires the written consent of all parties after written disclosure of the consequences. A disclosure placed in the purchase agreement or lease does not count.

From Code of Virginia § 54.1-2139. Disclosed dual agency and dual representation authorized in a residential real estate transaction · § 54.1-2139(A) and (D)

    Show answer

Section 55.1-713(A) says no cause of action arises against an owner or a real estate licensee for failing to disclose that the property was the site of a homicide, felony or suicide, or of an event with no effect on its physical structure.

Virginia real estate exam questions people ask

How is the Virginia real estate salesperson exam set up?

The exam has two portions that run 150 minutes together: 80 national questions in 105 minutes and 40 Virginia questions in 45 minutes. Unscored experimental items may be added, and they count against your time.

On the state portion, agency (12 items) and disclosure requirements (10 items) make up more than half of the 40 questions. Agents already licensed in another state take only that state portion.

How many hours of classes does Virginia require for a salesperson license?

Before the exam you need 60 hours in a Board-approved pre-license course, which state law describes as a course in the principles of real estate.

Once licensed, you have one year to finish 30 hours of post-license courses or the license goes inactive. After that, renewals take 16 hours of continuing education per licensing term.

What does Virginia law require in a brokerage agreement?

It must be in writing, state the fees, the services and a definite end date; without an end date it ends 90 days after signing. A licensee working for a buyer has to sign one before showing that buyer any property.

Dual agency in a home sale needs every party’s written consent after a written explanation of what it means, and that disclosure cannot be tucked into the purchase contract.

Virginia real estate exam FAQ

Do I take the whole Virginia exam if I am licensed in another state?

No. If your out-of-state license has not expired, you only pass the state part of the Virginia exam. The Real Estate Board still asks for the 60 hours of pre-license education, even for applicants coming by reciprocity. How long is a passing Virginia exam score good for?

One year. Board rules require first-time applicants to have passed within the 12 months before they file a complete application, so plan the fingerprints and paperwork right after the exam.
