OneTryPass wrote these questions from Georgia law, the commission's rules and the exam vendor's handbook. Pick an answer to see if you got it; each explanation names the section it comes from.

  1. Agency and brokerage

Question 1. Under Georgia’s Brokerage Relationships in Real Estate Transactions Act (BRRETA), what standard does a broker owe in carrying out its duties to a client?

    Show answer

Answer: B. Reasonable care in the duties set by BRRETA and the brokerage engagement

BRRETA section 10-6A-4(a) says a broker is not deemed to have a fiduciary relationship with any party and is responsible only for exercising reasonable care in the duties the chapter sets and, for a client, those in the brokerage engagement.

From InfoBase – Chapter 9 (Brokerage Relationships) | Georgia Real Estate Commission · Limiting Fiduciary Duties (O.C.G.A. 10-6A-4)

  2. Agency and brokerage

Question 2. A Georgia broker assigns one affiliated licensee to the seller and another to the buyer in the same sale, as designated agents. Who is a dual agent?

    Show answer

Answer: C. No one: the broker, its licensees and the firm are not deemed dual agents

BRRETA section 10-6A-13(b) says that when a broker appoints different designated agents for different clients in the same transaction, neither the broker, its licensees nor the firm is deemed a dual agent. Dual agency itself needs the written consent of all clients.

From InfoBase – Chapter 8 (Agency) | Georgia Real Estate Commission · Designated Agency (O.C.G.A. 10-6A-13)

  3. Disclosures

Question 3. Under Georgia Commission rules, when must a licensee disclose in writing whom the firm represents and from whom it will be paid?

    Show answer

Answer: A. In a timely manner, and no later than the time any party first makes an offer

Rule 520-1-.06(4)(b) requires a written disclosure to both sides of the party or parties the firm acts for and who pays it, made in a timely manner but no later than the time any party first makes an offer to buy, sell, lease or exchange.

  4. Contracts and offers

Question 4. A Georgia seller offers a listing in which the broker keeps whatever the house sells for above $300,000. What do the Commission rules say?

    Show answer

Answer: C. It is prohibited: brokers may not accept net brokerage engagements

Rule 520-1-.06(1)(c) prohibits brokers from accepting net brokerage engagements and requires the broker to add its fee so the client knows the gross price of the property and the broker’s services.

    From Ga. Comp. R. & Regs. r. 520-1-.06 Brokerage Relationships · (1)(c) Brokerage Engagements

  5. Disclosures

Question 5. A Georgia seller’s broker knows of an adverse physical condition in the neighborhood that a buyer could not find with a diligent inspection. How far from the property does the disclosure duty reach?

    Show answer

Answer: D. Within one mile of the property

  6. Licensing rules

Question 6. A Georgia salesperson candidate passes the exam but waits five months to apply for the license. What happens?

    Show answer

Answer: B. The candidate pays a fee equal to two times the original application fee

Rule 520-1-.04(5)(a) gives three months from the exam date to apply for an active or inactive license; after that the fee doubles, and after twelve months the candidate must retake the exam.

    From Ga. Comp. R. & Regs. r. 520-1-.04 Obtaining a License · (5)(a)

  7. Licensing rules

Question 7. Where does a Georgia candidate who passes the salesperson exam get the license?

    Show answer

Answer: D. At a PSI test center, no sooner than 24 hours after passing

GREC contracted with PSI to give the exam and to issue new licenses, which are issued only at PSI test centers. A candidate can apply 24 hours after passing, and no longer on the same day.

Question 8. What happens to a new Georgia salesperson who skips the postlicense course?

    Show answer

Answer: A. The license lapses if the 25-hour course is not done in the first year

The Commission requires a 25-hour Salespersons Postlicense course in the first year of licensure, and failing to finish it during that year causes the license to lapse.

Georgia real estate exam questions people ask

How many questions are on the Georgia real estate salesperson exam?

The format the Georgia Real Estate Commission announced for June 1, 2019 has 152 scored questions, 100 national and 52 about Georgia, plus 5 pretest questions that do not count, with up to 4 hours to finish.

PSI’s current bulletin breaks the Georgia part into 16 items on state laws and rules, 21 on real estate practice in Georgia and 15 on finance and closing, so practice questions outnumber the ones on laws and rules.

What score do you need to pass the Georgia real estate exam?

The Commission’s 2019 announcement set the bar at 109 correct answers out of 152, or 72%, counted over the whole exam.

Qualifying veterans can have 5 or 10 preference points added to the grade, but only after a failing score: the original score report and a DD Form 214 go to PSI within 60 days.

How many hours of classes do you need for a Georgia real estate license?

You need the 75-hour Salesperson Prelicense Course at a Commission-approved school. The alternatives are 10 quarter hours or 6 semester hours of qualifying college or law school courses, or 75 prelicense hours approved by another state or a Canadian province; those routes go through a PSI review before you can book.

A second course comes after the license: 25 hours of Salespersons Postlicense within the first year, or the license lapses.

How do you get your Georgia license after you pass?

You pick it up at a PSI test center, at least 24 hours after passing. Bring photo ID, your Certification of Accuracy statement, a GCIC criminal history report no more than 60 days old and the $170 license fee. Add a Sponsoring Broker Statement if you want the license active; without it, you get an inactive license.

Timing counts. Apply within three months of the exam or the fee doubles, and after 12 months you test again. Even then, you cannot start working until your broker has your wall certificate.

How do brokerage relationships work in Georgia?

Under Georgia’s Brokerage Relationships in Real Estate Transactions Act (BRRETA), a buyer or seller becomes a client only through a written brokerage engagement; anyone else is a customer, for whom a broker can still perform ministerial acts. The broker is not a fiduciary and owes reasonable care in the duties the law and the engagement list.

Dual agency needs the written consent of every client. A broker can avoid it by naming different licensees as designated agents for each side; then neither the broker nor the firm is a dual agent.
