Free New Jersey real estate practice test: 10 questions

OneTryPass wrote these questions from New Jersey law, the commission's rules and the exam vendor's handbook. Pick an answer to see if you got it; each explanation names the section it comes from.

  1. Agency and brokerage

Question 1. A New Jersey brokerage firm starts marketing a seller’s home, but nothing in writing names the business relationship. What is the firm under P.L. 2024, c.32?

    Show answer

    Answer: B. The seller’s agent

When no relationship is affirmatively designated, the Act treats a firm that performs brokerage services for a seller as the seller’s agent, and a firm working for a buyer as the buyer’s agent.

From DOBI Bulletin No. 24-11: Changes to the New Jersey Real Estate Broker and Salesperson Act by P.L. 2024, c.32 · Real Estate Brokerage Business Relationships

  2. Agency and brokerage

Question 2. In a New Jersey designated agency, one licensee represents the buyer and another represents the seller. In what capacity does the brokerage firm itself act?

    Show answer

Answer: C. As a disclosed dual agent

The designated agents owe fiduciary duties only to their own principals, but the firm (apart from those two licensees) acts as a disclosed dual agent. The firm needs the informed written consent of both parties first.

From DOBI Bulletin No. 24-11: Changes to the New Jersey Real Estate Broker and Salesperson Act by P.L. 2024, c.32 · Real Estate Brokerage Business Relationships

  3. Disclosures

Question 3. When must a New Jersey brokerage firm deliver the Consumer Information Statement to a party it will represent?

    Show answer

Answer: A. No later than when the party signs a brokerage services agreement

P.L. 2024, c.32 requires delivery as soon as reasonably practical, and no later than when the party signs the brokerage services agreement. An unrepresented party gets it before signing an offer or as soon as reasonably practical after.

From DOBI Bulletin No. 24-11: Changes to the New Jersey Real Estate Broker and Salesperson Act by P.L. 2024, c.32 · Consumer Information Statement

  4. Agency and brokerage

Question 4. Which statement about a transaction broker in New Jersey is true?

    Show answer

Answer: C. It represents neither party and is not required to keep information confidential

The Consumer Information Statement says a transaction broker works with the buyer, the seller or both without representing either one. It must treat all parties fairly and act competently, but it does not have to keep any information confidential.

From Consumer Information Statement on New Jersey Real Estate Relationships (DOBI Bulletin 24-11, Appendix A) · Transaction Broker

  5. Contracts and offers

Question 5. In which New Jersey transactions does P.L. 2024, c.32 require a written brokerage services agreement?

    Show answer

Answer: D. In all residential transactions, and with the seller in commercial transactions

The Act requires a brokerage services agreement with the buyer or seller in every residential transaction and with sellers in commercial transactions. It is not needed when the firm only gives a broker’s price opinion, a comparative market analysis or a bare referral.

From DOBI Bulletin No. 24-11: Changes to the New Jersey Real Estate Broker and Salesperson Act by P.L. 2024, c.32 · Brokerage Services Agreement

  6. Disclosures

Question 6. What must a New Jersey brokerage firm get from the seller in a residential sale?

    Show answer

Answer: A. A signed property condition disclosure statement

The Act requires the firm to obtain a signed property condition disclosure statement, the form promulgated by the New Jersey Division of Consumer Affairs. A seller with no brokerage firm must give it to the buyer before the buyer is bound by a contract.

From DOBI Bulletin No. 24-11: Changes to the New Jersey Real Estate Broker and Salesperson Act by P.L. 2024, c.32 · Property Condition Disclosure Statement

  7. Licensing rules

Question 7. A New Jersey salesperson takes a buyer’s deposit check with an offer. How soon must the money be deposited?

    Show answer

Answer: B. Within 5 days of receipt

N.J.A.C. 11:5-5.1 requires deposit money to be deposited within 5 days of receipt. If the offer is withdrawn before acceptance, or rejected with no counteroffer, during those 5 business days, the licensee may return the funds in the form received when the offeror asks.

Question 10. How many continuing education credits must a New Jersey salesperson complete to renew each two-year license?

New Jersey real estate exam questions people ask

How many questions are on the New Jersey real estate salesperson exam?

PSI gives one 110-question exam with a 4-hour limit, and the score is counted as a whole: 77 correct answers, or 70%, passes. Up to 10 unscored experimental questions can be mixed in, and they eat into your time.

The New Jersey law part of the outline is mostly about how licensees do business: 22 salesperson items cover the statutes and rules on advertising, broker and salesperson relationships, commissions, agency disclosure and escrow records.

How many hours of classes do you need for a New Jersey real estate license?

You need at least 75 hours at a school the Commission licenses; the course includes three hours of quizzes and the final exam. The school then sends your eligibility to PSI, and it lasts one year to the day.

After you are licensed, each two-year renewal takes 12 continuing education credits, including two in ethics, one in fair housing and one in agency. If your license is issued in the second year of a term, the first renewal needs none.

What do you do after passing the New Jersey real estate exam?

Get fingerprinted, meet with the broker who will employ you, and send the Licensing Services Bureau the score report signed by that broker, the fingerprint receipt and $160 together. Partial packages are not accepted.

New Jersey does not have reciprocity with any state, so an agent licensed elsewhere still goes through the New Jersey process.

What relationships can a New Jersey brokerage firm have with buyers and sellers?

There are five: seller’s agent, buyer’s agent, disclosed dual agent, designated agent and transaction broker. Designated agency arrived with P.L. 2024, c.32 in August 2024. If nothing is designated in writing, a firm working for a seller is the seller’s agent, and one working for a buyer is the buyer’s agent.

The firm explains these relationships with the Consumer Information Statement, which must be delivered no later than the signing of the brokerage services agreement and is made part of it.

New Jersey real estate exam FAQ

Does New Jersey have real estate license reciprocity?

No. The Commission says New Jersey has no reciprocity with any state. Its rules can waive the 75-hour course for someone who passed a state exam elsewhere after a 75-hour approved course and was actively licensed there within three years, but that person still takes the New Jersey exam. What is the Consumer Information Statement in New Jersey?

It is the form that explains the five business relationships a brokerage firm can have with you. Firms must give it to clients by the time they sign a brokerage services agreement, and to unrepresented parties before they sign an offer or soon after. A visitor at an open house does not have to sign for it before viewing. Are these the real New Jersey real estate exam questions?

No. OneTryPass writes its own practice questions from New Jersey law, the commission's rules and the exam vendor's candidate handbook, and each question names the section it comes from so you can check the rule. Exam vendors do not publish their live questions.

Is OneTryPass affiliated with the New Jersey Real Estate Commission or PSI?

No. OneTryPass is an independent practice site. Licensing rules and the candidate handbook are free on the New Jersey Real Estate Commission and exam vendor websites, linked on this page.
